A trust can be a highly tax-efficient way to hold assets for beneficiaries but as time passes, investments held within the trust may no longer generate the best returns or be the most appropriate from a tax perspective.
Under the Trustee Act 2000, in many cases it is not appropriate for trustees to make their own investment decisions. At the same time, beneficiaries may become unhappy with the investment performance of trust assets and blame the trustees, exposing them to the risk of litigation.
MT Financial Management offers a trust review service aimed primarily at professional trustees, such as solicitors and accountants, which is designed to enhance the trust services they provide while reducing litigation risks.
For a fixed fee we will review a trust, based on information supplied by the trustees, and advise on:
- the suitability of the existing investments, based on the objectives of the trust and the needs of any beneficiaries
- the tax treatment of the trust and any investments held within it, highlighting any improvements that may be achieved
- whether savings can be made on the costs associated with the trust investments.
We can also advise on setting up new trusts.
Our fees for any services in addition to the trust review will be confirmed once the trustees decide they wish to deal with any issues we have raised. We will not carry out any work until the fees and the services we propose to provide have been agreed.
